Job Seeker Visa vs Ausbildung Visa: Which Should You Choose?

These are two different legal permits solving two different problems: §17 AufenthG is for people who don’t have a training contract yet and want to travel to Germany to find one in person. §16a AufenthG is for people who already have a signed contract and are ready to start. Confusing the two — or assuming one replaces the other — is one of the most common planning mistakes we see. Here’s the actual statutory comparison, read directly from both provisions.

§17: The Job-Seeker Visa (No Contract Yet)

Under §17 AufenthG, you can enter Germany specifically to search for a vocational training place, subject to conditions stated directly in the statute:

  • Age limit: “er das 35. Lebensjahr noch nicht vollendet hat” — you must not have completed your 35th year of life
  • Secured livelihood: “der Lebensunterhalt gesichert ist” — your subsistence must be secured for the whole stay
  • Language: “er über ausreichende deutsche Sprachkenntnisse verfügt” — you must have adequate German language skills
  • Duration: the permit is issued for up to nine months — “Die Aufenthaltserlaubnis wird für bis zu neun Monate erteilt”

The German Missions in India’s own job-seeker checklist adds practical detail: you need proof your qualification is recognised for Germany (or that you’re pursuing recognition), a B1 German certificate if your training is already recognised, and financial proof — currently via a blocked account, sponsor declaration, or bank statements — of sufficient funds to cover your stay, alongside a motivation letter that must explicitly state your job-search plan, whether you’ve already applied anywhere, and why Germany specifically. Crucially, this visa does not include a work permit — you’re limited to unpaid trial periods of no more than 10 hours a week while searching.

§16a: The Training Visa (Contract in Hand)

Under §16a AufenthG, once you have a signed training contract, the visa is granted on the basis of Federal Employment Agency consent to the arrangement (§39 AufenthG) and — for qualified training — proof of sufficient German. Critically, §16a contains no age restriction whatsoever. It permits supplementary work of up to 20 hours a week alongside your paid training, and if your training arrangement ends through no fault of your own, you get up to six months to find another placement without losing your status. We cover the full requirement set in our dedicated §16a breakdown.

So Which One Do You Need?

If you already have a signed Ausbildung contract, you apply directly for §16a — there’s no reason to route through the job-seeker visa first. If you don’t have a contract and are over the §17 age ceiling, the job-seeker route legally isn’t available to you regardless of your qualifications; your path runs through securing a training contract from India first (through direct applications, partner employers, or a consultancy) and then applying under §16a, where age plays no role. If you’re under 35 without a contract, §17 gives you a legal basis to be in Germany and interview in person — but remember it’s a search visa, not a work visa, and the nine-month clock is firm.

We’ve written a full explainer on the age question specifically, since it’s the single most misunderstood part of this comparison: Is There an Age Limit for Ausbildung in Germany? The Real Answer.

Financing Either Route

Both visas require proof of secured funds if your situation doesn’t already cover it — via a blocked account or sponsor declaration. The specific threshold differs by visa category and is reviewed periodically by the missions; see our guide to the blocked account for the current figures and how to open one.
